RELEASE of LIABILITY; ASSUMPTION of RISK; INDEMNITY

In consideration of the Minor(s) listed on this form ("The Minor(s)") being permitted to enter the play area, to use the equipment or to participate in any event and/or program at Little City Play LLC, DBA The Little Play Co. ("The Little Play Co") located at 1400 Hudson Street Suite #1, Hoboken, NJ 07030, the undersigned, on his or her behalf of The Minor(s) and any personal representatives, heirs and next of kin (herein collectively referred to as ("the undersigned") identified below, hereby acknowledges, appreciates, agrees to and is fully aware of the risks and hazards in participating in any of the activities on the premises of The Little Play Co. and further agrees as follows:

I agree for myself and/or The Minor(s) listed on this form that we shall comply with all stated and customary terms, posted safety signs, rules, verbal instructions as conditions for play and participation in any program, activity or event at The Little Play Co. and agree to pay for all damages to the facilities of The Little Play Co. caused by myself or The Minor(s) listed negligent, reckless or willful actions.  I understand that both myself and the Minor(s) in my care will be asked to leave immediately if there is bodily harm caused to another child, regardless of the amount of time spent during the play visit.  I also understand that I may be denied entrance to or asked to leave The Little Play Co. in the event an employee feels my child, Minor(s) or myself is visibly sick.

In addition, if I observe any hazard during our participation, I will bring it to the attention of the nearest The Little Play Co. employee or official immediately.  I recognize and understand that there are certain inherent risks associated with the use of the play area, attending parties and programs and that risks of injury include, without limitation, scrapes ,bruises, cuts and even more serious injuries, such as paralysis or death.  Moreover, for myself and the Minor(s) named on this form, I fully accept and agree to assume all of these risks (including risks arising from the negligence of other participants), and I assume full responsibility for personal injury to myself and listed Minor(s) and irrespective heirs, assigns, administrators, personal representatives, and next of kin, completely and forever waive, release, indemnify, and hold harmless,The Little Play Co, its officers, members, agents, employees, other participants and sponsoring entities for injury, loss or damage arising out of or related to our participation in any and all The Little Play Co programs, classes, activities, parties, events, and/or the use of any of the facilities at The Little Play Co.This waiver and release shall be binding and apply to all risks, known and unknown, even if resulting from negligent actions of there guests or employees of The Little Play Co.

“Rules of Play” include but are not limited to:

(1) Parents/caregivers must supervise and must remain on premises with their children/minor(s) at all times.

(2) Parents/caregivers assume full responsibility for the conduct of their child/minor(s) while attending The Little Play Co.

(3) The Little Play Co. is not responsible for loss, damage or theft to/of your property.

(4) Glass (and other sharp objects), food, candy, gum and drinks are not permitted in the open play area.

(5) All participants (including children and their parents/caregivers) must remove shoes and socks must be worn at all times in the play area.

Each participant must sign this waiver form, either by them or if you are under the age of 18 years, then signed by a parent/legal guardian or designated representative by parent/legal guardian.  If a waiver is not signed, the person will not be able to participate in any The Little Play Co. program, activity or event and/or use the play area or equipment.

I, for myself, my child, ward or the The Minor(s) named below, consent to the publication of personal pictures or videos which may be taken by the little play co. personnel or their representative.  Publication may include but not be limited to, marketing materials, social media and websites.

THE UNDERSIGNED HEREBY WAIVES, DISCHARGES AND COVENANTS NOT TO SUE The Little Play Co., its members, owners, directors, officers, employees, volunteers and agents (collectively, the "Releasees") and RELEASES the Releasees from all liability to the undersigned or the minor(s) and all personal representatives, assigns, heirs and next of kin of the undersigned or The Minor(s), for any loss or damage, and any claim or demands on account of any injury to, or an illness or the death of, the undersigned or The Minor(s) whether or not caused by the negligence of The Little Play Co., other participants or otherwise while the undersigned or The Minor(s) is participating in any program, activity or event.  This waiver and release shall be binding and apply to all risks, known and unknown, even if resulting from negligent actions of the other guests or employees at The Little Play Co.

The foregoing document is intended to be as broad and inclusive as is permitted by the laws of the State of New Jersey and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I represent that I am the parent or legal guardian of the Minor(s) named on this form, or I have obtained permission from the parent/legal guardian of the Minor(s) named below to execute this agreement on their behalf. I further represent that the participants are healthy and physically able to participate in any and all undertaken activities.  I have read and understand the terms of this Release, Waiver and Indemnification and agree to its terms.
