RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT

In consideration of the Minor(s) listed on this form (“the Minor(s)”) being permitted to enter the play area, use equipment, or participate in any event, program, or activity at Little City Play LLC, d/b/a The Little Play Co. (“The Little Play Co.”), located at 1400 Hudson Street, Suite #1, Hoboken, NJ 07030, the undersigned parent or legal guardian (“the Undersigned”), on behalf of themselves and the Minor(s), hereby acknowledges, understands, and agrees as follows:

ACKNOWLEDGMENT OF NON-CUSTODIAL, PARENT-PRESENT MODEL

I understand and acknowledge that The Little Play Co. is a non-custodial, parent-present play and enrichment space. The Little Play Co. does not provide childcare, supervision, custodial care, or drop-off services.

I understand and agree that I remain solely responsible for the supervision, behavior, safety, and well-being of the Minor(s) at all times while on the premises, including during open play, classes, parties, programs, and events.

ASSUMPTION OF RISK

I acknowledge that participation in play activities involves inherent risks, including but not limited to scrapes, bruises, cuts, falls, collisions, and more serious injuries, including permanent injury or death.

I knowingly and voluntarily assume all such risks, whether known or unknown, foreseen or unforeseen, arising from participation in activities at The Little Play Co., including risks resulting from the actions of other participants.

RULES, HEALTH & CONDUCT

I agree that I and the Minor(s) will comply with all posted rules, safety signage, verbal instructions, and customary terms of participation. I understand that:

• Parents/caregivers must remain on the premises and actively supervise their children at all times
• Parents/caregivers assume full responsibility for the conduct of their child(ren)
• The Little Play Co. reserves the right to ask any participant to leave if behavior creates a safety or health concern
• Entry may be denied or participation ended if a participant is visibly ill
• The Little Play Co. is not responsible for loss, damage, or theft of personal property

RELEASE OF LIABILITY

To the fullest extent permitted by the laws of the State of New Jersey, I hereby waive, release, discharge, and covenant not to sue The Little Play Co., its owners, members, officers, directors, employees, agents, volunteers, and representatives (collectively, the “Releasees”) from any and all claims, demands, causes of action, or liability arising out of or related to participation in activities at The Little Play Co., including claims arising from the ordinary negligence of the Releasees.

This release does not apply to acts of gross negligence or willful misconduct, to the extent prohibited by New Jersey law.

INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Releasees from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising out of or related to my or the Minor(s)’ participation in activities at The Little Play Co., except to the extent prohibited by New Jersey law.

MEDICAL AUTHORIZATION

In the event of an emergency, I authorize The Little Play Co. staff to seek emergency medical treatment for myself or the Minor(s) if I cannot be reached immediately. I agree to be financially responsible for any medical treatment provided.

PHOTOGRAPHY & MEDIA CONSENT

I grant permission for photographs and/or video recordings of myself and/or the Minor(s) to be taken by The Little Play Co. or its representatives and used for marketing, promotional, social media, and website purposes. If I do not consent, I understand that I must notify The Little Play Co. in writing prior to participation.

SEVERABILITY & GOVERNING LAW

This Agreement is intended to be as broad and inclusive as permitted by the laws of the State of New Jersey. If any portion is held invalid or unenforceable, the remaining portions shall continue in full force and effect.

This Agreement shall be governed by and interpreted in accordance with the laws of the State of New Jersey.

ACKNOWLEDGMENT & SIGNATURE

I represent that I am the parent or legal guardian of the Minor(s) named below, or that I have obtained permission from the parent/legal guardian to execute this Agreement on their behalf. I further represent that all participants are physically able to participate in activities at The Little Play Co.

I acknowledge that I have read, understand, and voluntarily agree to the terms of this Release, Waiver, Assumption of Risk, and Indemnification Agreement.
